"SPARTA -- A property owner on Houses Corner Road has been ordered by the township to stop a dump operation, and police have issued tickets to truck drivers who are leaving the site for leaving mud on the highway.
The issue of dumping on the property at 309 Houses Corner Road reemerged last fall, leading to a citation by the Sussex County Soil Conservation District for mud being tracked into the road and erosion concerns within the nearly 10-acre plot of land.
There were also concerns about what was being carted into the lot, and Sussex County Health Department officials were called to investigate. Enforcement of the county's solid waste management plan is given to the Health Department.
If the site is accepting construction debris -- and piles of such items appear to be on the site -- the site would need to have approval of the county Board of Chosen Freeholders as an addition to the county's solid waste plan.
Such approval would come after the state Department of Environmental Protection gives its approval to such a change.
Officers most recently cited the operations at 5:55 a.m. Tuesday on a charge of violating the township's noise ordinance, which prohibits construction site noise before 7 a.m.
Police spokesman Lt. John Lamon said workers were using a power washer to clean off a truck before it left the site.
He noted than on Feb. 21, the driver of a propane-carrying tractor-trailer reported to police he almost lost control of his rig when it struck slippery, muddy conditions as he passed by the lot.
"He said he managed to regain control and there was no damage," said the lieutenant, but several truckers were ticketed for leaving mud.
On Tuesday, Police Chief Neil Spidaletto said police cars have been keeping a watch on the site, checking as trucks leave to be sure they aren't leaving mud on the highway. He said officers have also taken video from the street of operations.
Lamon said at this point, the case is being handled with civil actions.
Township officials said there may be further court action seeking a contempt citation against the owner or operator for violating stop-work orders.
According to Sussex County tax records, the nearly 10-acre site is owned by Keila Transport LLC, with a Newark address.
The chief said trucks entering the site seem to be coming from several different companies. He said getting solid information about the origins of loads has been difficult.
Township Manager Bill Close also noted that "details seem to be lacking" with respect to the operation.
The tax records show the land was purchased by Keila Transport on Aug. 21, 2017, for $550,000, and carries an assessed value of $556,100. Taxes last year were $17,806.32.
